Terms of service

Plain-language terms that govern your use of the metcha iOS app and the metcha.io website. By using metcha you agree to these terms; if you don't, please don't use the app.

1. The service

metcha is a real-time conversation translation app for iOS, provided by the maker of metcha ("we", "us", "metcha"). The marketing site lives at metcha.io. These terms apply to both the app and the site. Our Privacy policy is incorporated by reference.

2. Eligibility

You must be at least 13 years old to use metcha. If you are under the age of majority in your jurisdiction, you may only use metcha with the involvement of a parent or guardian.

3. Accounts

metcha does not require an account. Subscription state is managed through your Apple ID by Apple.

4. License to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the metcha app on devices you own or control, for personal, non-commercial use, subject to these terms and Apple's Standard EULA, which also governs your use of the app.

5. Acceptable use

You agree not to:

  • Use metcha to translate audio of people who have not consented to being recorded or transcribed where consent is required by law.
  • Reverse engineer, decompile, or attempt to derive the source code of the app, except where applicable law expressly permits it.
  • Use the app to transmit content that is unlawful, harassing, defamatory, or that infringes anyone's rights.
  • Attempt to interfere with the integrity, performance, or availability of the service, including by uploading malware or by abusing voice cloning to impersonate someone without their consent.
  • Resell, redistribute, or commercially exploit the app or its outputs without our written consent.

6. Voice cloning

metcha Plus offers a voice-cloning feature that produces a synthetic voice from a sample you provide. By using this feature, you represent that the voice belongs to you, or that you have explicit, informed consent from the person whose voice is being cloned. Cloning a third party's voice without that person's knowing consent is prohibited under these terms and may also violate the law where you live.

7. Subscriptions (metcha Plus)

7.1 Plans and billing

metcha Plus is offered as an auto-renewing subscription with three options: Weekly ($6.99/week), Monthly ($21.99/month), and Annual ($209.99/year). Prices are in USD; the App Store will show your local price at checkout. Payment is charged to your Apple ID account at confirmation of purchase.

7.2 Auto-renewal

Your subscription will automatically renew at the same price and for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

7.3 How to cancel

You can manage and cancel your subscription at any time in Settings → Apple ID → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; you will continue to have access to metcha Plus until then.

7.4 Free trials

Free trials are available, where offered, once per Apple ID and only on the monthly and annual plans. If you do not cancel before the trial ends, your subscription will begin and you will be charged at the end of the trial period.

7.5 Refunds

All subscription purchases are processed by Apple. Refunds are handled directly by Apple under its standard Report a Problem process. We are not able to issue refunds for App Store purchases. EU and UK consumers retain their statutory rights where applicable.

7.6 Price changes

If we change the price of a subscription, we will notify you before the change takes effect on your account, in accordance with App Store rules. Continued use after the change means you accept the new price; you can cancel before renewal if you don't.

8. Third-party services

metcha relies on third-party providers including Apple and a small number of cloud services for live speech-to-text, voice synthesis, optional cloud-assisted translation, real-time signaling, and form submission. When you use features that depend on those providers, your interactions with them are governed by their own terms and privacy policies. Categories of providers are described in our Privacy policy; specific sub-processors are available on request.

9. Intellectual property

metcha, the wordmark, the two-circle motif, the website copy, and the app's UI are the intellectual property of metcha and its maker. You may not use them in a way that suggests an endorsement or affiliation we have not granted. You retain all rights to the content of your own conversations and any voice clone you create.

10. Feedback

If you send us feedback, you grant us a non-exclusive, royalty-free, worldwide license to use it to improve metcha. You don't owe us feedback, and we don't owe you compensation for it.

11. Disclaimers

metcha is provided on an "as is" and "as available" basis. Translation is hard, and even the best models occasionally produce errors. We do not warrant that translations will be accurate, complete, or fit for any particular purpose. Do not rely on metcha for high-stakes communication (medical, legal, emergency) without a qualified human interpreter.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, metcha and its maker, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of metcha. Our total liability for any claim is limited to the greater of (a) the amount you paid us for metcha in the twelve months before the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the limitations above apply only to the extent permitted.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of metcha, your violation of these terms, or your violation of any third party's rights — including any unauthorized voice cloning.

14. Termination

You can stop using metcha at any time. We may suspend or terminate your access to metcha if you violate these terms or if continued provision of the service is no longer commercially reasonable; in that case we will give you reasonable notice where practical. The sections of these terms that by their nature should survive termination — including §6, §9, §11, §12, §13, and §16 — will survive.

15. Changes to these terms

We may update these terms when the product or our legal obligations change. The "Effective" and "Last updated" dates at the top of the page will change. For material changes, we'll surface a notice the next time you open the app or visit the site. Continued use after the new terms become effective means you accept them.

16. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these terms or metcha will be brought in the state or federal courts located in Delaware, and you and we consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you have as a consumer under the law of the country where you live.

17. Apple-specific terms

You acknowledge that these terms are between you and the maker of metcha, not Apple, and that Apple is not responsible for metcha or its content. Apple has no obligation to provide maintenance or support for the app. In the event metcha fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price (if any) for the app to you. Apple is a third-party beneficiary of these terms and may enforce them against you.
